{"id":4112,"date":"2014-12-03T16:40:32","date_gmt":"2014-12-03T16:40:32","guid":{"rendered":"http:\/\/www.africlub.net\/awdf\/?p=4112"},"modified":"2015-08-13T13:17:36","modified_gmt":"2015-08-13T13:17:36","slug":"disability-in-africa-bridging-the-gap-between-legislation-and-action","status":"publish","type":"post","link":"https:\/\/awdf.org\/OldSite\/disability-in-africa-bridging-the-gap-between-legislation-and-action\/","title":{"rendered":"Disability In Africa &#8211; Bridging the Gap between Legislation and Action."},"content":{"rendered":"<p><span lang=\"en\">Across much of Africa people with disabilities struggle on a daily basis with accessing public facilities and seeking their means of livelihood. At the heart of their problems \u00a0is access and exclusion. They are routinely denied access to public facilities, to employment and the right to full lives and inclusive love. What legislation there has been on the ground to ensure better lives for people with disabilities is still inadequate \u00a0&#8211; although there have been some developments. In places where formal legislation does not currently exist, countries are usually already signatories to the UN Convention for the Rights of Persons with Disabilities (CRDP).<\/span><\/p>\n<p><span lang=\"en\">Even South Africa with one of the most developed disability bills on the continent, \u00a0has its difficulties with implementation. Of the estimated five \u00a0million South Africans living with disability, 95 percent remain unemployed. Sixty percent of South Africa\u2019s disabled children are unaccounted for by the education department. Access to public buildings and transportation remains low.<\/span><\/p>\n<p><span lang=\"en\">Nigeria on the other hand, has only recently signed its disability bill into law. This bill owes its existence to years of advocacy by groups \u00a0within the country like the Family Centered Initiative For Challenged Persons (FACICP), \u00a0\u00a0which has visibly demonstrated \u00a0an incredible commitment by individuals and groups pushing for disability rights in Nigeria.<\/span><\/p>\n<p><span lang=\"en\">New legislation outlines rules requiring access for the disabled in all public buildings and imposes fines for failure to comply &#8211; \u00a0(one million Naira or dlrs 6,000 ) or two years imprisonment, or both. \u00a0But \u00a0in a country with a history of poor policy implementation, there is scepticism about enforcing these new laws.<\/span><\/p>\n<p><span lang=\"en\"><b>Bridging The Gap.<\/b><\/span><\/p>\n<p><span lang=\"en\">So far, the job of bridging the gap between awareness, legislation \u00a0and implementation, has rested largely on grassroots and advocacy \u00a0organizations which choose to engage.<\/span><\/p>\n<p><span lang=\"en\">Uganda\u2019s \u00a0Kajjansi Disabled Development Group (KDDG) \u00a0and the AWDF grantee partner Journalists Against AIDS (JAAIDS) in Nigeria are two organizations which have made a tremendous impact on lives of the disabled.<\/span><\/p>\n<p><span lang=\"en\">Since 1996, the KDDG has worked to improve the quality of life of people living with disabilities through its self-help approach. It provides a much needed facility for women in Uganda who are disabled to an income making brick and pottery.<\/span><\/p>\n<p><span lang=\"en\">In Nigeria, the JAAIDS has worked for years to ensure that communication channels exist between policy makers and the general public. One of its notable achievements is mobilising media activism and community participation to reduce the stigmas associated with HIV\/AIDS.<\/span><\/p>\n<p><span lang=\"en\">Women and girls who live with disabilities are vulnerable to sexual assault. In Nigeria societies scarcely make room for people who suffer from conditions other than the easy to identify ones because the ways that disability is understood excludes anything that is not obvious or immediately identifiable.<\/span><\/p>\n<p><span lang=\"en\"><b> What Needs To Improve?<\/b><\/span><\/p>\n<p><span lang=\"en\">Beyond the work that these organisations do, more people need to get involved. We need to keep this conversation alive within our communities and not just for these sixteen days of activism. We appreciate \u00a0the work of groups like the African Women\u2019s Development Fund (AWDF) which directly help \u00a0these organisations by giving \u00a0them access to the funds that they need.<\/span><\/p>\n<p><span lang=\"en\">Recently, on my way to Lagos, Nigeria\u2019s most metropolitan city, a lady came up to my bus in a town where we had stopped to eat and buy fuel. She had with her an envelope that she passed around with the words Ebonyi State University Association of Deaf Students written boldly on it. Underneath that was a request for the donation for learning aids.<\/span><\/p>\n<p><span lang=\"en\">Like most Nigerians, I had grown cynical of transactions like this because of the many stories of people faking disabilities and making their living as beggars, but I gave her some loose change I had with me and then I tried to have a conversation with her. Clearly, my sign language sucked. She laughed at me, thanked me and went on to the next person.<\/span><\/p>\n<p><span lang=\"en\">The Ebonyi State University Association of Deaf Students is \u00a0most likely non-existent and she was probably just another person with a disability trying to survive in Nigeria. But it highlighted for me \u00a0the lack of \u00a0options and absence of structures in place to cater for our disabled. \u00a0This gap continues to impact Nigeria\u2019s human resources and \u00a0to represent socio-economic loss.<\/span><\/p>\n<p><span lang=\"en\">&nbsp;<\/span><\/p>\n<p><span lang=\"en\"><em><a href=\"http:\/\/www.africlub.net\/awdf\/wp-content\/uploads\/2014\/12\/Kechi-Nomu_opt.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4123 alignright\" src=\"http:\/\/www.africlub.net\/awdf\/wp-content\/uploads\/2014\/12\/Kechi-Nomu_opt-252x300.jpg\" alt=\"\" width=\"137\" height=\"162\" \/><\/a>Kechi Nomu is a Nigerian writer and a member \u00a0of the African Women\u2019s Development Fund\u2019s (AWDF) Community of African Women Writers. <a href=\"http:\/\/www.africlub.net\/awdf\/african-women-writers-introducing-the-class-of-aww14\/\">Click here to learn more<\/a>. Au c\u0153ur de leurs probl\u00e8mes l&#8217;acc\u00e8s et l&#8217;exclusion. Ils se voient r\u00e9guli\u00e8rement refuser l&#8217;acc\u00e8s aux \u00e9quipements publics, \u00e0 l&#8217;emploi et le droit \u00e0 une vie pleine et d&#8217;amour inclusif. Ce\u00a0que la l\u00e9gislation, a fait\u00a0sur le terrain afin d&#8217;assurer une vie meilleure pour les personnes handicap\u00e9es est encore insuffisante &#8211; bien qu&#8217;il y ait eu certains d\u00e9veloppements. Dans les endroits o\u00f9 il n&#8217;y a pas actuellement de l\u00e9gislation formelle, les pays sont g\u00e9n\u00e9ralement d\u00e9j\u00e0 signataires de la Convention des Nations Unies pour les droits des personnes handicap\u00e9es (CRDP).<\/span><\/p>\n<p><span lang=\"en\">M\u00eame l&#8217;Afrique du Sud avec l&#8217;un des projets de loi les plus d\u00e9velopp\u00e9s d&#8217;invalidit\u00e9 sur le continent, a ses difficult\u00e9s avec la mise en \u0153uvre. Sur les quelque cinq millions de Sud-Africains vivant avec handicap, 95% restent au ch\u00f4mage. Soixante pour cent des enfants handicap\u00e9s de l&#8217;Afrique du Sud sont port\u00e9s disparu par le d\u00e9partement de l&#8217;\u00e9ducation. L&#8217;acc\u00e8s aux b\u00e2timents et aux transports publics reste faible.<\/span><\/p>\n<p><span lang=\"en\">Le Nigeria d&#8217;autre part, a r\u00e9cemment sign\u00e9 son projet de loi d&#8217;invalidit\u00e9 dans la loi. Ce projet de loi doit son existence \u00e0 des ann\u00e9es de plaidoyer par des groupes dans le pays comme\u00a0Family Centered Initiative For Challenged Persons (FACICP), qui a visiblement fait preuve d&#8217;un engagement incroyable par des individus et des groupes qui poussent les droits des handicap\u00e9s au Nigeria.<\/span><\/p>\n<p><span lang=\"en\">La nouvelle l\u00e9gislation \u00e9nonce les r\u00e8gles n\u00e9cessitant un acc\u00e8s pour les personnes handicap\u00e9es dans tous les b\u00e2timents publics et impose des amendes pour non-respect &#8211; (un million de nairas ou dlrs 6000) ou deux ans d&#8217;emprisonnement, ou les deux. Mais dans un pays avec une histoire de mauvaise application des politiques, on\u00a0est sceptique quant \u00e0 l&#8217;application de ces nouvelles lois.<\/span><\/p>\n<p><span lang=\"en\"><strong>Combler le foss\u00e9.<\/strong><\/span><\/p>\n<p><span lang=\"en\">Jusqu&#8217;\u00e0 pr\u00e9sent, la t\u00e2che de combler l&#8217;\u00e9cart entre la sensibilisation, la l\u00e9gislation et la mise en \u0153uvre, a repos\u00e9 en grande partie sur la base et les organisations de d\u00e9fense des droits qui choisissent de s&#8217;engager.<\/span><\/p>\n<p><span lang=\"en\">Uganda\u2019s \u00a0Kajjansi Disabled Development Group (KDDG) et\u00a0le\u00a0partenaire b\u00e9n\u00e9ficiaire d&#8217;AWDF Journalists Against AIDS (JAAIDS) au Nigeria sont deux organisations qui ont eu un impact consid\u00e9rable sur la vie des personnes handicap\u00e9es.<\/span><\/p>\n<p><span lang=\"en\">Depuis 1996, le KDDG a travaill\u00e9 \u00e0 am\u00e9liorer la qualit\u00e9 de vie des personnes vivant avec un handicap par le biais de son approche d&#8217;auto-assistance. Il propose \u00e9galement un centre bien n\u00e9cessaire pour les femmes en Ouganda qui sont handicap\u00e9es \u00e0 une brique de d\u00e9cisions sur le revenu et de la poterie.<\/span><\/p>\n<p><span lang=\"en\">Au Nigeria, le JAAIDS a travaill\u00e9 pendant des ann\u00e9es pour veiller \u00e0 ce que les canaux de communication existent entre les d\u00e9cideurs politiques et le grand public. Une de ses r\u00e9alisations notables se mobilise m\u00e9dia-activisme et la participation de la communaut\u00e9 \u00e0 r\u00e9duire les stigmates associ\u00e9s au VIH \/ SIDA.<\/span><\/p>\n<p><span lang=\"en\">Les femmes et les filles qui vivent avec un handicap sont vuln\u00e9rables aux agressions sexuelles. Au Nigeria, les soci\u00e9t\u00e9s font gu\u00e8re de place pour les gens qui souffrent de conditions autres que celle facile d&#8217;identifier parce que les moyens que le handicap est entendu exclut tout ce qui est pas \u00e9vidente ou imm\u00e9diatement identifiable.<\/span><\/p>\n<p><span lang=\"en\"><strong>Que doit-on am\u00e9liorer?<\/strong><\/span><\/p>\n<p><span lang=\"en\">Au-del\u00e0 du travail de ces organisations, plus de gens ont besoin de s&#8217;impliquer. Nous devons garder cette conversation en vie au sein de nos communaut\u00e9s et pas seulement pour ces seize jours d&#8217;activisme. Nous appr\u00e9cions le travail de groupes comme le Fonds de d\u00e9veloppement des femmes africaines (AWDF) qui aident directement ces organisations en leur donnant acc\u00e8s aux fonds dont ils ont besoin.<\/span><\/p>\n<p><span lang=\"en\">R\u00e9cemment, sur mon chemin \u00e0 Lagos, la ville la plus m\u00e9tropolitaine du Nigeria, une dame est venue \u00e0 mon bus dans une ville o\u00f9 nous nous \u00e9tions arr\u00eat\u00e9s pour manger et acheter du carburant. Elle avait avec elle une enveloppe qu&#8217;elle passait autour avec les mots Association Universit\u00e9 de l&#8217;Etat d&#8217;Ebonyi \u00e9l\u00e8ves sourds \u00e9crites hardiment sur elle. Sous ce qui \u00e9tait une demande de don pour les aides \u00e0 l&#8217;apprentissage.<\/span><\/p>\n<p><span lang=\"en\">Comme la plupart des Nig\u00e9rians, j&#8217;avais grandi cynique des transactions de ce genre en raison des nombreuses histoires de fausses personnes handicap\u00e9es et \u00a0gagnent leur vie comme des mendiants, mais je lui ai donn\u00e9 quelques billets que\u00a0j&#8217;avais avec moi et puis j&#8217;ai essay\u00e9 d&#8217;avoir une conversation avec elle. De toute \u00e9vidence, ma langue des signes l&#8217;a inspir\u00e9. Elle se moquait de moi, m&#8217;a remerci\u00e9 et a continu\u00e9 \u00e0 la personne suivante.<\/span><\/p>\n<p><span lang=\"en\">L&#8217;Association de l&#8217;Universit\u00e9 de l&#8217;Etat d&#8217;Ebonyi des \u00e9l\u00e8ves sourds est probablement inexistante et elle \u00e9tait probablement juste une autre personne avec un handicap essayant de survivre au Nigeria. Mais cela\u00a0a mis en \u00e9vidence pour moi le manque d&#8217;options et l&#8217;absence de structures en place pour r\u00e9pondre \u00e0 nos personnes handicap\u00e9es.
