Attorney General (Petition No.8 of 2014)-\u00ad\u2010 <\/span>the Constitutional Court has struck down Uganda\u2019s Anti-\u00ad\u2010Homosexuality Act, 2014 as unconstitutional. The ruling was delivered by a unanimous court of five members by Justices Eldad Mwanguhya and Steven Kavuma on behalf of a unanimous court made of three other justices: Justice Augustine Nshimye, Justice Ruby Opio-\u00ad\u2010Aweri, and Justice Solomy Balungi Bbosa.<\/span><\/p>\n<p><span lang=\"en\">The case was brought by a cross-\u00ad\u2010section of concerned Ugandan citizens to challenge the constitutionality of the Act on the grounds that it was passed when Parliament did not have the necessary quorum as required by the Constitution and the Parliamentary Rules of Procedure and also that it violated the constitutional guarantees of freedom from discrimination and from cruel, inhuman and degrading punishment, among others.<\/span><\/p>\n<p><span lang=\"en\">Only the ground of quroum was ruled on. The Court found that the Act should be nullified because there was no quorum in parliament on the day that it was passed as required by the Constitution and the Parliamentary Rules of Procedure, and that the Speaker committed an illegality when she allowed it to be passed without ascertaining that the quorum existed as required by the Constitution and the Parliamentary Rules of Procedure. That this was an illegality and the resultant law could not stand.<\/span><\/p>\n<p><span lang=\"en\">\u201cThe judiciary today has stood for the rule of law and good governance in striking out a law that was passed in a way that contravened the Constitution and the Parliamentary Rules of Procedure. This is a resounding victory for democracy in the country, and confirms that laws passed in violation of the Constitution cannot be allowed to remain on the law books\u201d according to Prof. J Oloka-\u00ad\u2010Onyango, the first petitioner.<\/span><\/p>\n<p><span lang=\"en\">\u201cThis victory is for all Ugandans. It is an affirmation of the independence of the Judiciary and of a growing democracy: despite populist politicians claiming support for the law, the Court has stood up for what is right,\u2019 said Adrian Jjuuko, Executive Director of the Human Rights Awareness and Promotion Forum (HRAPF), the ninth Petitioner.<\/span><\/p>\n<p><span lang=\"en\">According to sixth petitioner and Executive Director of Sexual Minorities Uganda (SMUG), Frank Mugisha, \u2018The striking down of the law removes a big yoke from the necks of many<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"column\">\n<p><span lang=\"en\">LGBTI persons who were criminalised for simply being who they are\u2019. In the few months since the Anti-\u00ad\u2010Homosexuality Act was passed by Parliament on 20 December 2013, activists recorded a marked increase in cases of violence against people known or suspected to be LGBTI (Lesbian, Gay, Bisexual, Transgender and Intersex). Sexual Minorities Uganda (SMUG) documented 162 cases of rights violations targeted against the LGBTI community during the period 1st December 2013 to 1st May 2014.<\/span><\/p>\n<p><span lang=\"en\">The court ruling also comes as a relief to civil society stakeholders and service providers who within weeks of the passing of the Anti-\u00ad\u2010Homosexuality Act in February 2014 were falsely targeted as being engaged in the promotion of homosexuality.<\/span><\/p>\n<p><span lang=\"en\">The petition was supported by the Civil Society Coalition on Human Rights and Constitutional Law, a Coalition of 50 civil society organisations that was established in 2009 to oppose the then Anti Homosexuality Bill. Le jugement a \u00e9t\u00e9 prononc\u00e9 par un tribunal unanime de cinq membres, dont les juges Eldad Mwanguhya et Steven Kavuma, et\u00a0les trois autres juges: les juges Augustin Nshimye, Justice Ruby Opio &#8211; Aweri, et Justice Solomy Balungi Bbosa.<\/span><\/p>\n<p><span lang=\"en\">L&#8217;affaire a \u00e9t\u00e9 port\u00e9e par une section crois\u00e9e ds citoyens ougandais concern\u00e9s, d\u00e9cid\u00e9s \u00e0\u00a0contester la constitutionnalit\u00e9 de la Loi sur les motifs qu&#8217;elle a \u00e9t\u00e9 adopt\u00e9e lorsque le Parlement n&#8217;avait pas le quorum n\u00e9cessaire tel que requis par la Constitution et le R\u00e8glement de proc\u00e9dure parlementaire, aussi il a viol\u00e9 les garanties constitutionnelles de libert\u00e9 de la discrimination et du ch\u00e2timent le plus cruel, inhumain et d\u00e9gradant, entre autres.<\/span><\/p>\n<p><span lang=\"en\">La Cour a conclu que la Loi doit \u00eatre annul\u00e9e car\u00a0il n&#8217;y avait pas de quorum au Parlement le jour o\u00f9 elle a \u00e9t\u00e9 adopt\u00e9e, tel que requis par la Constitution et le R\u00e8glement int\u00e9rieur du parlement, et que le Pr\u00e9sident a commis une ill\u00e9galit\u00e9 lorsqu&#8217;il\u00a0lui a permis d&#8217;\u00eatre adopt\u00e9e sans v\u00e9rifier que le quorum existait comme\u00a0requis par la Constitution et le R\u00e8glement int\u00e9rieur du parlement. Ceci est\u00a0une ill\u00e9galit\u00e9 et la loi qui en r\u00e9sulte ne peut\u00a0pas y r\u00e9sister.<\/span><\/p>\n<p><span lang=\"en\">&#8220;Le syst\u00e8me judiciaire d&#8217;aujourd&#8217;hui est synonyme de r\u00e8gle de droit et de\u00a0bonne gouvernance dans la suppression d&#8217;une loi qui a \u00e9t\u00e9 adopt\u00e9e d&#8217;une mani\u00e8re qui \u00e9tait contraire \u00e0 la Constitution et au\u00a0R\u00e8glement int\u00e9rieur du parlement. Ceci est une victoire retentissante pour la d\u00e9mocratie dans le pays, et confirme que les lois adopt\u00e9es en violation de la Constitution ne peuvent pas \u00eatre autoris\u00e9es \u00e0 rester sur les livres de droit \u00bb, selon le professeur J Oloka &#8211; Onyango, le premier requ\u00e9rant.<\/span><\/p>\n<p><span lang=\"en\">&#8220;Cette victoire est pour tous les Ougandais. Dans les quelques mois apr\u00e8s que\u00a0la loi anti &#8211; homosexualit\u00e9 ait \u00e9t\u00e9 adopt\u00e9e par le Parlement le 20 D\u00e9cembre 2013, les militants ont enregistr\u00e9 une augmentation marqu\u00e9e des cas de violence contre des personnes connues ou soup\u00e7onn\u00e9es d&#8217;\u00eatre LGBTI (lesbiennes, gays, bisexuels, transgenres et intersexes). Sexual Minorities Uganda (SMUG) a document\u00e9\u00a0162 cas de violations de droits cibl\u00e9s contre la communaut\u00e9 LGBTI au cours de la p\u00e9riode allant du 1er D\u00e9cembre 2013 au 1 mai 2014.<\/span><\/p>\n<div class=\"section\"><\/div>\n<p><span lang=\"en\">La d\u00e9cision du tribunal arrive\u00a0comme un soulagement pour les parties prenantes de la soci\u00e9t\u00e9 civile et les prestataires de services qui en quelques semaines apr\u00e8s l&#8217;adoption de la Loi anti &#8211; homosexualit\u00e9 en F\u00e9vrier 2014 ont \u00e9t\u00e9 faussement cibl\u00e9 comme \u00e9tant engag\u00e9e dans la promotion de l&#8217;homosexualit\u00e9.<\/span><\/p>\n<p><span lang=\"en\">La p\u00e9tition a \u00e9t\u00e9 soutenue par la Coalition de la soci\u00e9t\u00e9 civile pour\u00a0les droits de l&#8217;homme et de droit constitutionnel, une coalition de 50 organisations de la soci\u00e9t\u00e9 civile qui a \u00e9t\u00e9 cr\u00e9\u00e9e en 2009 pour s&#8217;opposer \u00e0 l&#8217;\u00e9poque au\u00a0projet de loi contre l&#8217;homosexualit\u00e9.
